"A pox on Canberra" cries Justice Marshall

The ABC brings word of an extraordinary outburst by visiting Judge Shane Marshall who wants to get the hell out of town and have no more to do with the ACT legal system (it ain’t no justice system IMHO):

“The entire saga of the Eastman jurisdictional issue has been attended with a bizarre attitude by the DPP,” he said.

“The DPP now seeks to further muddy the waters in an inappropriate way.”

He then took aim at the ACT Government saying the only way to secure the inquiry would be for the Government to have the intestinal fortitude to order an inquiry itself.

Justice Marshall told the court he plans not to work in the ACT again.

“This whole sorry saga is the reason why I will not be making myself available to sit again on this court in any capacity once my reserved judgments in three recent Court of Appeal matters have been published,” he said.

How many more appeals for Eastman, why wasn’t this evidence brought up before???? QUESTIONS QUESTIONS, so many rumours about this murder.

I mean how many more appeals does Eastman want, enough is enough, maybe this one will be different, and why wasn’t this evidence brought up before???????
So many rumours about this murder

Like almost everybody in Canberra (or so it seems) of a certain age I’ve known people who’ve had to deal with Eastman, and one bloke who used to live near him. He is a frightening and dangerous individual, and I’m quite happy for him to be off the streets and out of my way.

Furthermore, given the apparent impossibility of being convicted of murder in Canberra (at least until quite recently), the fact that Eastman was convicted, and various appeals have upheld the conviction, does lend some weight to the idea that he actually did kill Winchester.

However, if he didn’t kill Winchester, and is just a convenient local nutbag who looks good as a fall guy, then the triggerman is probably sitting comfortably somewhere in Calabria, sipping a nice glass of Sangiovese and enjoying the fruits of his labours. In other words, if Eastman didn’t do it, then the guilty bastard has got off scott free all these years, and the thought of that really irks me.

All the people who “know” the truth of it because their mate Barry told them the story while having a bong one day and other such nonsense should pull their heads in. In the meantime, a proper judicial inquiry should investigate this, and either exonerate Eastman (Allah spare me) or confirm his conviction once and for all.

Once that is done, we can get on with arguing furiously and anonymously on RA about things that really matter, such as the plastic bag ban, the lack of skill of Canberra drivers and the piss-poor performance of our local government.

Well he’s approaching 70 so i suspect Soviet will be hoping that the nutter will cark it before we determine unequivocally whether there has been a miscarriage of justice in this fiasco.

Surely he is “Justice” Marshall …….

The last thing the DPP and their friends in the AFP want is a far reaching inquiry into the Eastman affair.

So the visiting judge has spat the dummy because the Court of Appeal disagreed with his decision that Eastman was not entitled to yet another judicial enquiry according to his interpretation of the law.The Eastman saga has been a train wreck of monumental proportions.I think it’s time for a comprehensive review of all the facts and judgements to sort this mess out once and for all.

Well he’s lucky, he has a place to go back to. Most of us are bloody stuck ‘ere.
