ASIC has banned the director of a number of companies trading as Watch This Roof in Canberra, Darren James Penn, from managing corporations for four years.

Penn was under investigation by both ASIC and the ACT Office of Fair Trading over the closing down and insolvency of a number of companies. ASIC found that Mr Penn may have failed to carry out his duties as a director with care, diligence and good faith by offering warranties, repeatedly failing to meet his liabilities under those warranties and using the corporation structure to avoid warranties.

A RiotACT investigation looked at the issue of warranties given by Watch This Roof. We were unable to locate him at the time, but ASIC says he recently moved to the Newcastle area and has since filed for bankruptcy.

He is working for Ray White in Newcastle as a Real Estate Agent!! Good job for him!!

I tell this tale again and again to people who comment on how well my roof restoration is holding up. Lucky my Dad is a house painter and did it properly, that’s how I managed it.

I had the misfortune to work in sales for Mr Penn for a period of approx 6 weeks (around 6 years ago) before I came to my senses. His main selling point was that he WASN’T one of these companies that officially changes ownership every couple of years to avoid warranties.

Also watch out for: Blue Haven Pools – well known in the past for exactly this type of behaviour; ReACT Roofing – not sure yet if they are practicing this, but the owner is the Darren Penn’s/Watch This Roof’s ex-sales manager…..
