Justice Burns has allowed the appeal of G.B Seaars from the DUI conviction on the basis that it could have been any of the Rebels seen riding the bike.

Fun fact of the judgment is identifying 73 Heffernan Street as the Rebels clubhouse.

In fact, the Shooters Wholesale Warehouse have just relocated to a new shopfront down the road in Heffernan St. Bikies, guns and prostitution, all in one convenient location. 🙂

Justice Burns gave the magistrate somewhat of a serve

‘ Few are as cognisant as I of the pressure of work in the Magistrates Court, but no workload can justify such an egregious failure to provide one of the basic obligations of procedural fairness. In itself, the Magistrate’s failure to give reasons constitutes an error of law, albeit one of which the appellant has not complained in these proceedings’

The mistake the cop made was allowing the Reb to enter the clubhouse because at that point all bets were off.It wasn’t me guv it was him so bugger off!

I’m not so much disputing the location of the club, as wondering if they have gone about operating it in accordance with the law? I suspect they have, since they obviously are the attention of the legal system from time to time.

Those other “dubious” businesses you mentioned are all required to meet certain standards, licencing, etc to run. Does a “social club for like minded motorcycle enthusiasts” fall under a specific business regulation?

I believe that establishments such as tattoo parlours and gentleman clubs are generally owned/run by a certain local motorbike enthusiast club.

I also believe that brothels NOT owned or run by this same club, are paid ‘fees’ periodically to allow for the business to continue trading.

What sort of club are you referring to? Bridge club, or a Pommeranian Dog Owners club?
