Two men have been arrested early this morning by ACT Policing Criminal Investigations Detectives for the Australian Defence Force Academy (ADFA) incident in March.
The two men, aged 19 and 18, were arrested at ADFA about 7am and will face the ACT Magistrates Court later today.
Police will allege that on Tuesday, March 29, a female cadet was recorded without her consent engaging in consensual sexual intercourse.
The 19-year-old man has been charged with Use a Carriage Service to Cause Offence and Act of Indecency. The 18-year-old man has been charged with Use a Carriage Service to Cause Offence.
UPDATE: The SMH has named the pair as Daniel McDonald, 19 and Dylan de Blaquiere, 18.

The Navy makes Midshipmen do a year before they actually start at ADFA, why don’t the RAAF or Army?

While prejudicial behaviour has typically been used as the stick for beating Defence staff with for miscellaneous offences, the charge cannot relate to any civil offence. The reverse double jeopardy does not apply (i.e. someone charged under DFDA can still be charged in a civil court) which is a topic for legal debate considering the ramifications under internationally recognised rights.

Should have simply charged them under the Defence Force Disciplinary Act – they’d get far more impact under that than in the ACT Courts.
Mind you they can still be charged under the DFDA after the ACT Courts are finished with them for predjudicial conduct.

John XXIII College at ANU had rampant problems of this sort until a couple of years back when new management kicked out all the returning residents deemed to be problematic in an attempt to change the culture. I’m not sure how successful that would be in the long term though.
