Cross border lockdown

ACT Policing will collaborate with NSW Police members from Yass in a cross- border “lockdown” for Operation RAID (Remove All Impaired Drivers) this week.

Police will have highly-visible operations targeting drug and alcohol-impaired drivers from Monday, November 28 to Sunday, December 11. These enforcement activities are timed to coincide with the start of the festive season, which traditionally brings an increase in the consumption of alcohol and drugs.

Last year the operation ran for 17 days, from Friday, November 26, to Sunday, December 12. During this time 9456 breath-tests were conducted in the ACT with 72 drivers returning positive results and 283 Traffic Infringement Notices (TINs) being issued.

ACT Policing, in a joint operation with NSW Police, will be conducting a cross-border “lockdown”, stopping all vehicles coming into and out of the ACT. Last year more than 678 motorists were breath-tested in a four-hour lockdown, with three returning positive results.

Superintendent of Traffic Operations, Kylie Flower, is encouraging all road users who are intending to consume alcohol to plan ahead and make alternative transport arrangements to get them home safely.

“We don’t want you to become a statistic this Christmas. If you are celebrating this festive season, please nominate a designated driver or take public transport home,” she said.

“ACT Policing and NSW Police will be out targeting all motorists. This operation is specifically aimed at removing as many drink and drug-affected drivers as possible from our roads,” Superintendent Flower said.

ACT Policing, NSW Police and Victoria Police are participating in Operation RAID this year.

Sure, they could be done for some other offence nothing to do with being in control of a motor vehicle.

but, all the talk in the NSW legislation about authorised areas and police having the power to permit or deny entry, the ACT legislation says the conveyance must be searched in a public area, or some area where members of the public have ready access:

Nice, I umm just read the Human Rights Act 2004, from cover to cover, and no where did I find anything about not having to provide a fluid sample, if it was indeed the Human Rights Bill and not the Human Rights Act you were reading, you have to realise the bill is the law before it passes into government.

People who break the law violates my human rights to live safely in society, this should not be tolerated by society!

Legal system, suspicion or belief of guilt, arrested or summonsed, found guilty or innocent, yes good work there, I don’t know where you are going with the rest of it though?

You do realise if you do return a positive test, then the analysis is also positive, you aren’t guilty yet, you are then summonsed or arrested then taken to court to be found guilty or innocent. So no, no it doesn’t make it a direct breach of human rights legislation.

Tell it to the magistrate if you get caught Adarian. I’m sure they’ll agree with you. If random drug testing prevents some piece of pond life crashing their commodore or lancer into decent people, causing injury or death, then I’m all for it.
