Darwin man summonsed for Northbourne sexual assault

A 30-year-old man from Darwin has been summonsed to face the ACT Magistrates Court this week on sexual assault charges.

Police will allege the man sexually assaulted a 27-year-old woman in the early hours of Saturday morning, March 17, in her apartment on Northbourne Avenue.

Between 3 and 4 am the woman was walking back to her apartment from the CBD when she was approached by the man on Mort Street.

The man engaged in conversation with the woman, seeking her assistance. The woman allowed the man into her apartment where police will allege he has then sexually assaulted her.

The man will face court on Thursday, April 26, charged with a number of offences including act of indecency without consent, sexual intercourse without consent and sexual assault.

If all they are willing to pay somebody to spend a day working in court is $96, then no justice at all would get done.
Oh, but the *lawyers* and judges get their $2,000-$5,000+ per day. While jurors have to put up with $96?

Sorry, as long as this is the case, all you’re going to get for jury service are the underemployed whose time has that little value.

The reason that a lot of alleged rapes don’t end in convictions has to do with pesky things like evidence and presumption of innocence. What would you prefer?

Attitudes like mine? I was only making the point that people can be suspicious because there are instances of false accusation, and they very often make the news (the usual cycle of trial by media, charges being dropped, and then the media going very silent without so much an apology).

This leads many people to be wary of jumping to conclusions or automatically believing the accuser, although some take this a bit far and automatically assume they are lying.

What irritates me is that many get angrier at people who point out false accusations than the actual women who are making them, which apart from being heinous in of itself also makes things much harder for the real victims. The “women never lie” brigade are just as bad as the “women always lie” crowd.

Well, in fact, if I ever hear of one of our crim-friendly magistrates getting burgled, I will definitely be saying, “He deserved it”.

Neither I, nor anybody I know has ever said nor heard anyody else say of a rape victim that “she deserved it”, so I’m not sure WTF it is you’re talking about when you claim that “rape is acceptable”.

There was a bloke in Mawson charged with rape last year after he failed to pay a prostitute he had hired.
Now *that* one was complete bull$#!&. She should have had to go through the Small Claims Court like everybody else has to when chasing an unpaid bill.

Do I suppose we’ll change the charge of murder to “ending a life without consent”? We’ve already prettied up murder in the ACT to comply with PC standards, let’s not make the same mistake by trivialising other serious criminal acts.

Rape is rape. A spade is not a shovel if we care to acknowledge the difference.

And I wish the courts would stop calling it sexual assault or sex without consent – it just adds to watering down a serious crime.
