Drunk and disorderly

Hi all,

What are the specific laws/fines relating to drunk and disorderly behaviour in public spaces, in the ACT?

Also, how strictly are they imposed? Is it common for police to be called, say at a shopping centre, or even to some main street in the town centre, to fine/lockup drunks who are acting a bit silly?

Was very curious about this.. but can’t seem to easily find much on it (for ACT specifically) via google search.

they will usually just tell you to go home/strongly suggest your friends take you home. Unless you are by yourself then they will take you to the sober up shelter/ lock up to sober up. Unless you are being a huge douche or public nuisance then they will lock you up.

I’ve been quite drunk and fairly disorderly on one or two occasions and have never been fined or arrested. Although did come pretty close once.

You can find ACT legislation on Austlii (one of a few places)

INTOXICATED PEOPLE (CARE AND PROTECTION) ACT 1994 – SECT 4

Looks like this is the main Act that covers it but depending on what the “drunk” is doing in a public they might be charged with a number of other offences.

Some of the cases here

Have a look at the whole Act and it might have more details on what you are looking for.

If you find a bit you are interested in, click Noteup at the top and it will show you cases that refer to that bit of the Act.

Are you planning on getting in drunk in these places?
