Go to Google street view for 84 Mugga way, there’s an old guy checking the mail. Wonder if that’s Mr Freebody? Seems kind of odd a near 90 year old renting a house on Mugga Way. Odd way to spend your superannuation.

So a bloke aged 69 is considered middle-aged these days?

And why not, may I ask?

If I heard correctly, Costa was Freebody’s landlord. Courtesy of WIN News.

Appears Luigi Costa is a Justice of The Peace

I’ve just discovered that they resided directly opposite each other on Mugga Way, 85 and 84 so one could assume that there may have been some ill feeling between the two.

I wonder whether he’ll claim self defence or provocation?

I’m no expert on Criminal Law, but I can’t really see either working in this case.

Even if he did succeed knocking it down to manslaughter based on excessive force in self defence, at his age the sentence will still see him enjoy years behind bars.

But really, when the supposed ‘attacker’ is 89, I think most courts will have a hard time accepting either.
It would be a bit like the Hare shooting the Tortoise then claiming self defence… Hare was fast enough to escape anyway.

The big thing I think the defence will rely on will be that the accused was intoxicated at the time of the alleged murder, or that there was some mental condition at work at the time.

I was being a tad facetious not knowing at the time that he’d made the triple-0 call but just to be clear the law of excessive self-defence or defensive homicide does not exist in the ACT so it’s possible he could claim self defence although i just heard it was a frenzied attack ie. stabbing i suspect. More info required methinks.

From the ABC link:

“The court heard police went to the house after Costa made a triple-0 call saying he had been attacked and the attacker was still in his house.

But when police arrived they found Mr Freebody dead in the dining room.”

Interesting to see how this one plays out.

Right so he wasn’t killed on the road itself as the title states.
