Lost t-shirt causes murder case to be halted

The ABC has the story of one Christopher Griffin, of Condor, who was charged with attempted murder.

Supreme Court Justice Ken Crispin has today decided that Mr Griffin’s case cannot proceed because police have misplaced the t-shirt he was wearing at the time he allegedly stabed another man.

Apparently Mr Griffin was in a fight with one David Allan Maly, during which both men were stabbed. Mr Griffin claims he acted in self-defence.

Police had collected Mr Griffin’s t-shirt as evidence and forensic tests might have shown what type of knife caused a wound to his stomach, which Justice Crispin said was Mr Griffin’s last hope of supporting his claim of self-defence. The judge said because the t-shirt was missing, Mr Griffin’s chances of a fair trial were prejudiced.

I nearly asphyxiated while trying to read that incredibly long sentence without any commas or stops. Is there some kind on “reckless punctuation” charge that can be levelled.

It strikes me as odd that the police can lose vital evidence to a major court case. Do they not keep these items in secure storage at the property lockup in Belconnen?

i am the said david allan maly that was stabbed by christopher griffin
and i would like to say that he will be goin to trial in april for the said charge of attemped murder and i dearly hope he does get found guilty becouse i am the one who was stabbed in the chest and bled to death in the emergancy ward of the canberra hospital and if it wasnt for the efforts of the hospital staff i would not be here today so all my thanks and gratitude go to the canberra hospital for giving me another chance at life and a special thanks to all the blood donors in australia keep up the good work guys without your blood i would have lost my fight to live much love david allan maly
