Nasty rape case gets nastier

The Canberra Times brings word of Tuggeranong mayhem and intimidation of an alleged rape victim.

    The ACT Magistrates Court heard yesterday that the boyfriend of the 16-year-old girl at the centre of the case was attacked, his car was torched and her mother received abusive phone calls.

    A bail application hearing for one of the girl’s alleged attackers, 18-year-old Kalonga Chifuntwe, was told a cyber-bullying campaign against the girl had also intensified.

    All three of those accused of raping the girl deny the charges and none is accused of direct involvement in the harassment.

    Chief Magistrate Ron Cahill told the court he had no words for his horror at the girl’s treatment by some of her peers, and threatened indefinite time behind bars for anyone charged with harassment.

It’s not that hard to look up phone records or trace internet use if anyone’s motivated to actually follow it up.

Had a look. They have gone private now on their profile. But Google has cached their charges and the intimidation that the girl is undergoing. A good potential employer will Google them, which means they probably will never get a good job.

No, I know they have little intelligence, but they’re usually smart enough to have their profile set to private.

You make the error of assuming they have the intelligence to realise your point on their own. Until someone points out it could be detrimental they would have no idea.

I’m glad to see they’ve come so far since my dealings with them.

I was particularly concerned to see media reporting the names of two of the attackers, even though they suppressed the name of the 17 year old attacker, and the victim.

Naming the defendant where it may go toward identifying the victim is a serious issue.

Similarly reproducing facebook posts if they relate to the victim.

caf (@7), I think vg was referring specifically to the harassment of witnesses – that’s how I read it anyway.

I would feel dirty and unclean if my spelling was that bad. At least Ron Cahill is on the case.

Sigh, if only our Police were allowed to carry the Rattan and do some non religious moral policing.

There is also the Crimes Legislation Amendment (Telecommunications Offences and Other Measures) Act (No. 2) 2004.

(Schedule 1—Telecommunications offences, Part 10.6—Telecommunications Services, Division 474—Telecommunications offences, Subdivision C—Offences related to use of telecommunications)

474.17 Using a carriage service to menace, harass or cause offence
(1) A person is guilty of an offence if:
(a) the person uses a carriage service; and
(b) the person does so in a way (whether by the method of use or the content of a communication, or both) that reasonable persons would regard as being, in all the circumstances, menacing, harassing or offensive.
Penalty: Imprisonment for 3 years.
(2) Without limiting subsection (1), that subsection applies to menacing, harassing or causing offence to:
(a) an employee of the NRS provider; or
(b) an emergency call person; or
(c) an employee of an emergency service organisation; or
(d) an APS employee in the Attorney General’s Department acting as a National Security Hotline call taker.

Word is the girl and boyfriend are definitely being hassled, by mates of the alleged attackers.

And it’s not hard to look up phone records or internet usage at all, the only question is what the correct charge should be.

Oh yeah, and how about section 35:

(1) A person must not stalk someone with intent— … (c) to harass the person stalked.
(2) For this section, a person stalks someone else (the stalked person)
if, on at least 2 occasions, the person does 1 or more of the
following:

(e) gives or sends offensive material to the stalked person or
leaves offensive material where it is likely to be found by,
given to or brought to the attention of, the stalked person;

(f) telephones, sends electronic messages to or otherwise contacts
the stalked person;

(g) sends electronic messages about the stalked person to anybody
else;

(h) makes electronic messages about the stalked person available
to anybody else;

(j) engages in conduct amounting to intimidation, harassment or
molestation of the stalked person.

I now await the usual patronising response.

It’s pretty clear what he’s trying to say.

No-one is motivated enough to actually follow it up.

Jam that in your pipe and smoke it.

If they’ve thought of it, why is this girl still being harassed?

Why aren’t the idiots behind these tactics hauled in? Are they so special they are free to do this to the victim?

According to the Bullying! No Way. website:

“If you are being harassed online, take the following actions immediately:

Report to police. If the bullying includes physical threats, tell the police. Some people think that they can get away with it because they believe it is anonymous. They are wrong. Most can be traced and it’s a criminal offence to use a mobile phone or any form of communication to menace or harass or offend another person.”

They also recommend that other students:

Take a stand against cyber bullying. Speak out whenever you see someone being mean to another person online. Most people respond better to criticism from their peers than to disapproval from adults.”

I hope that the police will catch those kids responsible and haul them up before Ron for a severe attitude adjustment!

If anyon can find a charge of ‘harassment’ in the Crimes Act give me a yell as well. Threaten or intimidate witness, yes. Harassmet, no.
