No Indemnity Insurance for Canberra Teachers?

Mrs JTK came home last night, full of wonder and excitement regarding the new changes that will force the previously wayward children to continue in their education till they turn 17, instead of allowing the ones who don’t care to simply bail at 15 as they used to.

The conversation rapidly turned to the difficulties she would encounter having ‘Duty Of Care’ for the kiddies, when they are allowed to leave the premises between classes. This flowed onto an interesting story about a high school teacher who lost their house through having been found to have breached their “Duty Of Care” when a kiddie made a mistake and lost a finger in a workshop class.

What, says I??? Surely the Departments Professional Indemnity Insurance covers this???? Mrs JTK firmly believes that the schools, and the department do not have any coverage, and that the teachers are covering everything out of the goodness of their hearts……

O.M.G !!! I have been a consultant for years, and years, and my employer holds Professional Indemnity Insurance. The professional associations I am a member of hold Indemnity Insurance for their members, everything is covered.

Are Public Servants actually putting their homes on the line in doing a wonderful job for the community, while putting up with crap salaries???

Does anybody have any more info? A letter has been drafted for the Education Minister, and an application for Indemnity Insurance has been made to cover her, but this is crazy and insane…..

Thats all well and good – where is it written down, and how could somebody have lost their house.

Quote has arrived $2080 for $10mil. Seems simple enough. And – yep it will be rolled back in through tax.

Kids are, by and large, morons, and they’re getting stupider.

Madam S4anta is in the same boat. Just go out and purchase cover for $10mil and fold the cost back thru tax. Peace of mind rather than fighting the public service. The added bonus is that it covers a bunch of other random scenarios that haven’t even popped up on the radar yet.

As a (ridiculously) small businessman, I am required to hold a $10million public liability insurance policy, in case the job goes really pear shaped. This is of course required for ACT Government contracts.

First of all I am not a lawyer \ insurance broker.
Second of all, if Mrs JTK is working as a consultant (not an employee) then she would have to provide her own public liability insurance, but here is the catch, the company ( \ school) which employed her as a consultant would need to have made her aware of the requirement to carry her own liability insurance otherwise they themselves may be in a world of hurt if something went wrong.

Now here is the other thing, if she is a consultant, chances are there is a management company sitting somewhere in the mix (unless she is charging the school GST), and if so they would be more than likely providing the insurances.

I’d suggest finding out exactly how Mrs JTK is employeed with the school, and speak with an insurance broker if required.

BTW I personally believe the kids who are 15 and want to leave school should be allowed to. It’s not like they learn anything anyway and they disrupt the students who either want to be there, or know they have to be there to get into the career they want.

Here’s a story about a kid that bail school at 15 and i’d say he has a pretty bright future ahead of himself.

my understanding that if there is a gross lapse in duty of care, then you can get assistance from the union, but that’s about it.
