Part 2: Owners Corporation Nightmare

Thanks to everyone who helped me with direction a few weeks ago regarding my Owners Corporation (of which I am 1/8 th). I realised that the lack of decision regarding 2 years of blocked storm water etc. was more of a ploy by some owners to never approve any work rather than any issue that could be solved at a meeting with another round of lip service followed by zero action. There is no issue of course with work they don’t have to pay for out of money that is already stockpiled in the budget/sinking fund, they couldn’t approve fast enough the $1200 hedge that I paid for out of my own pocket!

I took the matter to court on Tuesday. I would have done well to have a lawyer with me on the day as it was tough, even though one had helped me prepare the application it was challenging and I think I might need one in 3 weeks just I case the OC try to confuse the issue as they did on Tuesday.

Of course the magistrate was able to see through all the lame excuses they had made over the last two years (and yes they did spew them up in court once more!) and asked that the owners return in 3 weeks with quotes for the work and show the court that they are moving quickly to resolve the issue. This will be the 3rd set of quotes.

The system is different to NSW where there is a court that deals with OC issues and no doubt in the future ACT is going to need one given all the new unit blocks.

So if you are thinking of taking on your OC I know someone else who has had success as well but brace yourself it is a bumpy ride and as someone warned on my last post , yes I am now the most unpopular kid on the block …………at least with the old school owners!

Be interesting to see how costs are awarded, assuming you ask for a judgement on costs. You might end up 1/8th funding their defence!
