A 21-year-old Banks man will face the ACT Magistrates Court today after police apprehended him having sex with a 14-year-old girl early this morning (Wednesday, June 22).

About 3.10am members from Tuggeranong Police Station were conducting a routine patrol of Hume when they came across a car with heavily fogged windows.

The members approached the car and found a 21-year-old man having sexual intercourse with a teenage girl in the back seat.

The man was arrested by police and taken to the ACT Regional Watch House where he was charged with Sexual Intercourse with a young person under the age of 16.

Police will be opposing bail.

The issue of consent is the problem, as the law would not consider a 14 year old mature enough to make the right call, therefore the idea of consent is dubious. Also a big difference if the sexual partner is 21. I can’t believe you think the actions of police are harming this couple. I would say the actions of the 21 year old are harming the 14 year old. You really need to check yourself if you don’t get this. I really hope you don’t have daughters to pass on your pearls of wisdom.

Agreed it is about consent – with the difference in developmental stages between a 14 year old and a 21 year old it cannot be said that the young(er) person in a situation like this actually has the experience and ability to judge the potential consequences of sex with an older guy and so make an informed decision about their actions. I’m generalising a bit but I’d say it’s pretty rare that a 21 year old fella has the best interests of a younger person at heart as opposed to just wanted to get his end in. It’s not entirely impossible though. What is close to impossible is that the police will be able to do anything about it the illegality of it. Without knowing more information it’s hard to say whether this guy is a predator or simply a loser who can’t get chicks his own age.

One of my oldest and dearest friends, now a senior medical specialist in Sydney, was hard at it with his girlfriend in his car down by the shores of Lake BG back in the early ’80’s when he was interrupted in mid stroke by two cops knocking on the window. After hastily adjusting his clothing he stepped out of the car and the police, hugely embarrassed, asked him if he’d heard any gunfire in the previous few minutes, as they’d had a “shots fired” report on 000.

My mate told them the only bang he was aware of was the one they’d just interrupted. You just don’t find grace under pressure like that these days.. 🙂

Yep, pretty much. Any car parked at 3am with people inside is potentially suspicious and would normally be checked out.

It will go to court and the 14year old girls witness statement will have a few in consistencies with the guys account of the incident and the magistrate will, as in virtually every other case in the ACT, have to let him off. I feel sorry for the police who will now have to keep this event in there calendar as they attend hearings on and off for the next six or eight years whilst our court capitulates over a ruling.

Slicker – I hope I don’t spoil your “fond” memories but the only reason a 16 plus year old male would have sex with a 13 year old girl is because they either didn’t realise their actual age or they couldn’t find a 16 plus year old female who would agree to do the job. I’m glad you’re not scarred but I think you would be the exception not the rule and personally I think it’s revolting.

R.Slicker, it is child exploitation no matter how anyone chooses to justify or distort it. Whilst it would appear the young person agreed to participate, in many cases the damage is not fully understood for years to come. It is with good reason that children are not legally able consent to a range of things, including sexual intercourse, until they are much older than this kid.

I’d have thought that most cars exposed to the elements at 3:10am in a Canberra winter would have heavily fogged windows.

There seems to be no issue of consent, but surely a 21yo would think about the fact that she’s 14 and that would set off a few alarm bells.

So a 14 year old girl is out and about with 21 year old boyfriend at 3am on a school night? Sounds like some quality parenting.

She was staying up rather late on a schoolnight…

Hope the AFP members involved are getting some trauma counselling after seeing that!!
