Small Business suffering due to poor planning by ACT Planning & Development

You may have seen several articles in The Northside Chronicle over the past few weeks highlighting the negative impact all the construction on the south-eastern end of Emu Bank is having on local business in the area due to lack of parking and access. As one of the businesses currently being affected, I would like to know what rights, if any, small business has to claim against ACT Planning & Development for lost revenue and growth? It’s certainly clear there has been some poor planning decisions made with the approval of 3 separate major construction works occurring in one small area concurrently – should small business be compensated for this mis-management?

From my perspective, I am now going out of business, and will likely be closed down by the end of the year if I cannot relocate in the meantime. Unfortunately my lease still has 2 years to run, and with the landlord advising me it’s not his fault and there’s nothing he can do, that leaves me seeking some sort of compensation from the planning department. Will I have a chance of success, or should I be seeking compensation directly from the construction companies?

Nice use of the word “offing”. Without googling, does anyone else know what it means?

Its a corruption and contraction of the phrase ‘effing next few weeks’

ConBel23, you have my sympathy. I wish I had advice for you, but all I can do is second the recommendations above.

Thanks for the offer of the magic beans there mate, but when you’re on the verge of losing everything due to the fact that your customers can’t access your business, and no-one wants to take responsibility for the mess, you tell me what I’m supposed to base my decisions on? I’d love to be able to afford some hot shot lawyer to fix all my problems, but given the fact that I can’t even break-even in my current location, that’s just not possible (P.S if you check out the front page of this weeks n’side chronicle, you’ll know exactly what I’m referring to).

All I’m looking for is a little direction and advice so I can start sleeping at night, and maybe find some constructive way out of this situation that’s not going to leave me broke….
