Frequently Asked Questions

What is the difference between a civil and criminal lawyer?

In general terms a criminal lawyer represents matters of private conduct between individuals, organisations, and government agencies. These matters tend to be disputes between one entity to another and centre around protecting rights and responsibilities. A criminal lawyer on the other hand represents matters of state or federal crime. These matters typically evolve around the accused offenders and related punishments.

What two main areas do criminal lawyers practice in?

Generally criminal lawyers practice in two areas, either as those who defend the accused, and those who specialise in their prosecution. While some may practice across both, most will have expertise aligned to one or the other. Moreover, some criminal lawyers may also specialise in niche areas such as victim representation.

Why should I use a criminal lawyer?

Representation from an experienced criminal lawyer can fundamentally change the outcome of a case. It can navigate clients through the complex legal landscape, keep stress and disruption to minimum, and reduce exposure to risk. Importantly, a criminal lawyer provides support throughout the entire process, presents all evidence and any applications properly, along with finding weaknesses in the oppositions case. Each situation is different, so for do seek appropriate legal counsel to assess all options.

How much does a criminal lawyer cost?

Legal fees do vary quite significantly when it comes to criminal lawyers. Some firm may offer a fixed fee structure while others work to an hourly rate. Additional charges may also apply based on the number of anticipated court attendances. Most criminal lawyers do bill by the hour, and this charge will vary depending on their level of experience, the type of case, and the firm in which the work. A junior may charge from $200 per hour with an experienced partner charging $800 per hour or more. On average expect to pay between $300 to $400 per hour.

What questions should be asked of a criminal lawyer before hiring?

Naturally, requirements of a criminal lawyer will depend on the nature of their hire. That said, it is worth asking a few questions to help assess their fit. These questions could be centred around whether they will personally be handling the case; their experience in similar cases; frequency of court and other appearances; frequency of communication; along with billing and payment terms.

Michael from Kamy Saeedi Lawyers recently represented me in a drink driving charge. I found Michael to be very knowledgeable of the type of charge I was facing and the legal process we needed to follow. Michael was very clear in his instructions to me and helped me understand the process. I felt very comfortable and confident that I was in good hands. We achieved the best outcome that I could’ve hoped for all thanks to Michael’s representation.

Given that you have no information whatsoever, I’d rate that as the crap comment of the month.

That’s a big call given that this is RA and the month is only seven days old.

Although I didn’t write it, I meant “…of the month so far”, which means it’s only a fairly moderate call really. Still, accusing someone of being a kiddie porn drooler on the basis of nothing at all is a pretty outstanding effort.

No TAD. This doesn’t involve any child pornography at all.. It’s interesting how this is the first thing that pops into many peoples heads.

I don’t know if you have had any previous experience with lawyers. Just so you are forwarned, they are not cheap.

Most lawyers will charge at least $250 to $300 an hour for your run of the mill solicitor, anywhere up to $800 an hour for a parnter of special counsel. Smaller firms generally have lower rates than the larger firms.

If you defend the matter in Court a barrister will charge you a daily fee of around $4,000 depending upon their experience etc.

Wait, what? The defendant has to pay court fees? I thought this was the prosecutors job.

Umm… Of course court is not free… Normally the loser pays court fees

You’re an idiot. Stop offering idiot advice, you idiot.
CRIMINAL. Not civil.

Ignore them.
For some reason there are numpties who can manage to open and comment on a thread without seeing the word “Criminal” in the title. Court fees apply to civil matters last I checked.

The lawyer you need may depend on the nature of the crime of which the person involved is accused. Not knowing the detail of the crime alleged, I would recommend Karen Fogarty from Colquhoun Murphy. She has a science degree (math) and is quite computer literate.

You thought it was the prosecutor’s “job” to pay for your defence?

Mate…

Without you providing more information it is a bit hard for anyone to offer any more meaningful advice.

xceL – I am not sure what you mean by the Defendant having to pay Court fees? I was referring to what your defence team might charge you. If you are found not guilty you can apply for costs from the prosecution, but even if costs are granted it won’t be for the full amount.

kos – You don’t need to get an “evidence warrant”, if proceedings have been commenced you can simply get a subpoena issued for that information. Quite a simple matter.

A lawyer who knows what they are doing and a case will cost upwards of 10k, you’ll need to decide not only if its worth it, but if you have sufficient evidence. As computer intrusion is actually a crime, you should be able to enlist the assitance of the police, in our case the AFP. Call Ph:(02) 6223 3216 to get them directly or log a normal case on 131444. For other help;

CERT AU may provide some assistance for free, I have had them contact me in regards to personal data on the internet etc.

https://www.cert.gov.au/

AUSCERT Are non government and in Brisbane and provide excellent support and information to private enterprise on incidents.

http://www.auscert.com.au/

DBCDE/ACMA provide some support to private enterprise on information security;

http://www.staysmartonline.gov.au/
http://www.acma.gov.au

DSD have singalled many times that they are interested in helping both Government and Private, but as a private entity it is hard to even get them to say hello to you.

http://www.dsd.gov.au/

If the evidence isn’t handled correctly from day dot (copy taken, time drift noted and sighted, chain of evidence etc) then your case will be fairly useless. In order to get any additional information from 3rd parties such as telecommunications carriers you will need not only a case logged with the police but an evidence warrant, and you’ll need this in order to prove that something happened on the malicious attackers end as well as your end (eg it wasnt spoofed).

It won’t take long to rack up $10,000 in legal fees. I have seen some defended matters that have dragged on and racked up many times that amount in legal fees.

Most lawyers will generally give you the first consultation free, but don’t expect much from it, it will probably only last 15 minutes. They will usually tell you that they need more information and details from you and you will require further appointments for which you will be billed.

If you do engage a solicitor they will give you a cost agreement to sign which should details their costs and their estimate of what the case should cost you.

Pesky viruses put child porn on your computer hey? Pay an expert enough, he’ll confuse the jury with enough techno babble to get you off.

Thanks, I’ll look into that 🙂

I’m only after an initial consultation so I feel it would be handy to speak to a solicitor who has some experience or knowledge of computers or cases to get the right advice.

You could try Jason Parkinson at Porters Lawyers, I know that he has experience in that area. Jason is also a former policeman so he is familiar with police procedures.

Most decent lawyers, even if they are computer savvy, will still call in a recognised IT expert to consult with and to provide expert evidence in Court.

Disclaimer – I previously worked with Jason many years ago.
