Yass Valley Council, development applications, and building a house.

Hey guys, just wondering how any of you have gone with the Yass Valley Council. We have just submitted plans for a new residential home, and we got knocked back on, so they say, section 2 88B covenants, saying that we can’t use colourbond on the walls as cladding. I’m pretty sure they are interpreting the rule to suit them.

It states that; the building must be of new materials, including, brick, stone, concrete, timber glass and aluminium and profiled building boards. I’ve shortened it a little but that is the most part of what they are saying it doesn’t fit, yet they have approved my neighburs house, which has colourbond and one down the road from straw, which definitely isn’t a new material, it’s recycled.

As far as i’m concerned, it states;

A new material;

Including, brick, stone, concrete, timber, glass, aluminium and profiled building boards. (NOT inclusive of those items only) i.e. a list of some materials, but others may be used.

So i think that colourbond fits into that when broken down to its proofs, as it doesn’t say that you can’t and the list states, including NOT inclusive of these materials only. Any law guru’s out there with how they interpret it? They also stated that the aluminium is designed for windows. Well it doesnt say that on the 88B!

So anyway we are now looking at Aluminium cladding. Does anyone know any suppliers in the ACT? If you look at the Belconnen Arts Centre it has the Aluminium cladding that we are after, (the flat panels on the angle with the standing seam) but we want it either vertical or horizontal, nlot on the angle. It looks great and I can only find a supplier from Sydney. They do a bit of work down here. (Doing the ANU at the moment with the big flat panels). So any ideas on suppliers here please?

Our house is architecturally designed, complete north facing with cedar double glazed argon windows, polished concrete, hydronic heating, 30degree pitch roof for ultimate angle to make the most of the sun for the solar hot water and solar panels. Its not like its just a masterton home, but it seems that they are so behind the 8 ball in yass that they don’t want any designer homes, just project homes like masterton and av jennings etc, with the old brick vaneer finish. Wouldn’t they like to have some designer homes in the little estates in murrumbateman to improve the quality of the area???

Thoughts please as to where i can go to get the colourbond approved on the 88b (NSW) or the aluminium panels in Canberra (its a lot more expensive though) but will it be worth it and as it states aluminium on the 88b, can i use it for panelling and not just for windows as they want to try interpret it???

There are certain regulations in the NSW council area I’m currently building in which I now wish I’d questioned as we may have ended up with something that better meets our needs. Structures outside the council regulations can be approved, and most council workers really do want to help you get the best result.

BTW, I’m building a colourbond house, really good product to build with, looks great finished.

Are you building out in Murrumbateman??? If so, does it happen to be Carrington???

Hey Capn_pugwash; Are you using it on your walls? It’s Ok for the Roof but they are saying that we can’t use it for the walls. Well they aren’t letting us any way. Yes Sue was great when we were there and its Barbara Gilbert who is doing the application and she spoke with Josh who gives the final say or the final sign off of the plans. He stated that they interpret it that we can’t use it.

Have you read the 88B???? How do you interpret it?????? Have your plans been signed off????? Sorry just read that yours has been approved. Have you started yet?

I am very confused now, as you have said that you have approval, yet ours has been rejected and we are using the same colour, C-bond. Well we want to. We now have to get our designer to change our plans to have brick vaneer which we will have some face and rendered with cedar but would like to have the c-bond.

Who approved your plans? Can you please email me. That adds up to three houses i now know then that have been approved yet they won’t approve ours???

hi bundyjack – we are also in carrington park and using ironstone colourbond – let’s hope we aren’t right next door to each other – although both our houses will look great! it’s really strange!! who have you been dealing with? my husb did a lot of the follow up and he spoke with Sue a fair bit who was helpful. Good luck with it all

Can you just built the house with wooden walls? Then after approvals are all complete, um, repaint it with, um, colourbond?

capn_pugwash; Mate our plans well and truly stated the colour we wanted. (Iron Stone) on the walls and they said that it doesn’t meet the covenants. Although they approved my neighburs, which has colourbond on it and also a straw bale house which def doesn’t meet the section 88B. We are in Carrington Park, so its different to Merryville.

BTW Gal is actually allowed, it’s just zinc that you cant have because it’s reflective. We want the Gal and it’s OK with them for the roof but not the c-bond for the walls, yet they have approved others with it… It doesn’t state that you can only use so much c-bond pannelling. They are interpreting the 88B to suit themselves, so i want to find out what i can do legally to get it, seeing they approved others! I think Merryville doesn’t have the same 88B as what Carrington does. Is this where you are? If so it would be great to meet and have a chat seeing they have approved your use of c-bond.

hi there we are building a (possibly) similar house this year. Our plans were approved by yass council. We have a mix of colourbond cladding and rendered finish. It could be possible that you didn’t state what colour you were going to use?? There has been a kerfuffle lately with someone on merryville estate using plain (galvanised) tin on their entire house which is definitely not permitted. That’s the only reason i can think of from our experience… or perhaps you need to use less c-bond panelling… although being a semi-rural area you would think they would be all for it. Good luck – we found the approval process took about 4 months but the council themselves were good to deal with.
