Zeddite v. Pogo rumble slated for 27 March

The Canberra Times is still quoting combatants as neutral officiators in the Humphries v. Seselja deathmatch wracking the Liberal Party for the winnable Senate seat.

But the story does at least clear up that the big meeting to decide on overturning Zed’s preselection victory is to be held on 27 March.

The prevailing sentiment on these pages seems to be that Zed and his supporters have been too clever by far and the preselection will be annulled following the wave of outrage from disaffected party members. While that is mostly correct, his opponents may have overestimated their ability to overturn the preselection.

The motion before the special party meeting seeks to rescind the Management Commitee decision that established the preselection process and timetable, and then relies on all actions and outcomes from that process and timetable being declared invalid. But the preselection decision was made when the process and timetable was valid. It does not follow automatically that when the process and timetable are invalidated retrospectively that all actions and outcomes arising from it at a time when it was valid then become invalid. And, most importantly, the preselection decision was made by the members, not by the Management Committee. Even if the motion to rescind the election process and timetable is overwhelmingly passed at the special meeting the Management Committee may simply ignore it, in fact may be compelled to ignore it, because the preselection decision has already been made and was made by the members at a time when the process and timetable was valid.

Retrospectivity is the antithesis of the rule of law. The rule of law requires that you have laws which you can find out about, understand and comply with. Retrospective laws create offences and illegality where none previously existed. It brings the law into contempt. Everyone should be able to be in a position to order his or her affairs on what the law is. They should not have to comply with a law that is changed after they have ordered their affairs.

The power to overturn a preselection decision in the current circumstances appears to be absent in the ACT Liberal party rules and is not supported by the general rule of law. It may take lawyers at 10 paces to actually sort this out!

Al not very happy I’m told.

Anyway back to Zed, Steve Doyle and Tio.

Their arrogance is unbounding. They have been planning this since the 2008 election.

And they could only pull off a 30 person victory.

FYI why Humphries supporters didnt have voting rights.

There are 2 types
1. Party Faithful – who had been working their dots off for the last election out everynight letterboxing rather than going to meetings whether or not they believed in Zed. So didnt have voting rights.

2. Don’t go to meetings since Zed took over the Party with the help of moderate defector President Winnifred Rosser who in 2009 supported Zeds cronies being voted onto Management Committee to sure up her own position, They didn’t go because Zed’s goons would openly harrass them at meetings for raising any issue that Zed didn’t want to talk about. These people are still good liberals just have better things to do rather than being abused by Zed’s young lib thugs and other goons at meetings.

Most of the people in category 1 just dont like conflict and would like the bickering to stop.

The people in Catergory 2 are the ones that Zed, Steve & Tio have pissed off with this underhanded non ethical approach to the senate pre selection.These are the members who are now fighting the Zeditte forces to gain control of their party back again.

Less than clever to piss some of these people off.

It would be smart of Al to pull his support before he gets dragged into this and the hard right have a hard word about his future as well.

Finally Liberal party HQ has got its act together and scheduled this special meeting. Now Zed is spruiking about the benefits of all the party qualifying meetings to be held in the weeks before the 27th. Good to see he is a fan of a grassroots democracy, if only belatedly. Shame his backers didn’t see the light months ago – would have avoided all the current unpleasantness.

We understand that Alistair Coe is getting married later this month. Al is of course Zed’s key numbers man and right wing factional warrior. Al might want to defer his honeymoon so he can keep his finger on the pulse. Not much good lying on a nudie beach in Thailand while Zed’s effort falls over back home. Any way, speculation is rife that Al will soon pull the plug on the whole sordid affair and leave Zed stranded like a teetotaller at a buck’s night. Many of Al’s hitherto loyal supporters are questioning his involvement in the whole Zed charade and whether he really did do a deal for the leadership as suggested by the Canberra Times. Trading Senate spots for Assembly spots, if that is what occurred, will not go down well with the broader party membership. Al also needs to save face with the national Liberal right and his Young Liberal followers who must be wondering how anything could be handled so badly.

If the local Libs sold tickets for ringside seats at the March 27 shindig they would be able to pay off the reputedly enormous party debt and buy Zed a one way ticket to South Korea where he could end his days with his beloved moonies, away from the Canberra Liberals’ lynch mob that is now bearing down on him.
