Spitting blood on bouncer during Mooseheads violence deemed 'particularly disgusting'

Between throwing a punch or a headbutt, a violent brawler spat blood into a bouncer’s face, which a magistrate said was “particularly disgusting”.

Court documents show 20-year-old Zak Maynard was seen punching another patron in the face at about 2:30 am at Mooseheads Pub & Nightclub on 12 June 2021.

A bouncer saw the assault and tried to take Maynard out of the club, but Maynard tried to escape and headbutted him in the nose.

Maynard eventually had to be taken to the ground, then looked towards the bouncer and spat blood onto his face.

When police arrived and tried to escort him away, he told an officer: “I am going to f-king kill you.”

He tried to headbutt this officer, saying: “Hit me, I’m going to kill you.”

He threw his body into the officer, then was taken to the ground and had to be carried into a police car.

“Nothing good ever comes out of Civic after 1:00 am and this case is an exemplar,” prosecutor Ms Lee told the ACT Magistrates Court on Monday (1 November).

She said Maynard’s decision to get drunk that night had exposed others to a risk of injury.

“But the defendant is fortunate that his aim appears to be quite poor,” she said.

The third-year apprentice painter from Wagga Wagga told the court he needed a Defence Force pass to continue working at the RAAF base at Kapooka, and he might not be able to obtain such a pass if he had a conviction for violence.

Magistrate Peter Morrison said he had been a member of the military and from his understanding, this wasn’t correct. Maynard agreed to continue with his sentencing.

Magistrate Morrison said Maynard identified that poor decision making, liquor consumption and anger contributed to his offending, while character references said this behaviour was out of character.

He found the fact Maynard spat blood into the bouncer’s face to be “particularly disgusting”.

Maynard pleaded guilty to charges of assault, fighting in a public place and resisting a public official. He was convicted and fined $2000.
