So. It appears the higher levels of judiciary, in all their wisdom, have decided to overturn the Tenancy Tribunal’s decision to evict everyones favourite Cop Killer, David Harold Eastman.

So a badly needed Housing property will be sitting vacant for another 20 odd years or until this germ gets shanked in Goulburn.

Rejoice.

I believe that David Eastman has been framed.Just like Lee Harvey Oswald a PATSY.They let Eastman live because they knew no one would believe him.Oswald on the other hand had to be silenced because he would be believed.Winchester’s mistake was that he knew too much and would be believed.For all who think that Eastman is guilty,you fell for a three card trick.If you want to get on the right track look no further than the Nugan Hand Bank and work your way down.

Weird that this gets resurrected now. Only a couple of weeks ago I met a close relative of Winchester’s over a couple of beers, after three or four I got the courage to raise the whole Eastman thing – strangely (or predictably from my point of view) he didn’t think that Eastman killed Colin and offered a number of other reasons that Winchester might have been done over that were related to his extensive connections with organised crime figures. He did temper all of this with the qualification that he knew no more about it than the average joe, but it struck me that this was a close relative not just anyone with a view. The truth: we’ll probably never know…

I have no doubt myself that David Eastman is innocent of the murder.

Two 0.22 bullets is the mark of an organised crime hit – as happened to George Freeman before (Freeman survived).

The people who gave evidence he was at the gunshop, turned up very late to give evidence, several years after the murder – and one of them was said to be related by marriage to one of the police involved in the case.

They tape recorded thousands of hours of Eastman alone in his flat, and got one phrase – but acoustics experts could not agree on what he said. The phrase was “he was the first man I ever killed”, but it did not make sense to me in the context that was quoted.

I have no doubt Canberra is a breeding ground for disgruntled ex public servants who might occasionally be heard to make death threats under their breath, if their homes were bugged for thousands of hours. Many people (though from a lower social class than Eastman) make (joking) death threats in public, as part of their conversation. So many people would be taped making several death threats, if recorded for thousands of hours like Eastman was.

See whereas I thought if you were convicted of murder, you had no rights other than to be put in jail and fed.

WTF is going on in this world when a lowly maggot like Eastman can still keep a Govvie flat and there are people, who have never commited a crime, and are living on the streets or in emergency accommodation because Housing has nothing?

Eastman has plenty of rights. Why do you think he still has the housing property, the good will of the minister?

He did receive notice Hugo. Plenty of it. At least a week from the Tribunal and months from ACT Housing before that.

OK Binker. Habeas Corpus means that you must show that the accused of any action should be available to bear witness before the court. In this case apparently, nobody bothered to inform Eastman of what was happening and his rights in the matter. Regardless of some of the right wing loonies who write to rioact, even people in gaol have rights and must receive natural justice an the procedural fairness given by habeas corpus.

I’m sorry, but he was convicted in a Court of murder. The Coroner thought there was more than enough evidence there to have this vermin indicted in the first place.

I’m with Thumper – the bloke’s a dangerous lunatic and completely erratic. Well, I know that probably describes a few Riotacters as well, but Eastman is one bloke who should never again be let loose. A bit different to Milat, but society needs to be protected and the cops (and courts) have done us a favour. Of course, Eastman contributed to his own incarceration – if he’d played it differently, he’d be out now.

I met Eastman once, after his bail.

Give them points for enterprise, I reckon. Some very quick thinking, and killed 2 birds with one stone.

I always like a good David Eastman story anyway – I can almost sense the adrenalin of the guys that fitted him up – the rude kind of way that Eastman just refuses to go away, just wont accept that he’s been worked over and put up with it … they’d always be wondering whether or not one day, some judge will actually pay attention to what the poor prick is raving about, put two and two together and come up with four (contrary to the evidence presented by the crown or counsel representing the AFP who have always argued that two and two make three or five – depending on whether you think its not beyond the relms of probability to have one of the cops who searches Eastmans house coincidently pull over for a pee on the side of the highway and ‘find’ a gun bag matching one sold in Queanbeyan by a dead guy that just happens to contain a bottle of Eastmans perscription medicine…

“habeas corpus” (have the body) ?relevance to this matter which is one of natural justice/procedural fairness.

We have had habeas corpus for x centuries, and, by god, we need it. Action cannot be taken against Eastman without telling him and allowing his voice to be heard. This applies to anyone, anywhere, for whatever reason (except apparently, David Hicks)

I guess that’s the beauty of the internet Al. You just never know who you’re talking to and what they know. Maybe I’ll see you around sometime.

the only reason he can’t be evicted yet is that it is not yet 6 months since his final? appeal failed. when this comes around he will have no right to the property. makes sense.

Don’t get me wrong – he’s an absolute nutter and a menace but you’ve got to see the hilarity in taking a paranoid schizophrenic who is convinced that there is a conspiracy out to get him and fitting him up for the execution of the local police commissioner cum underworld mover and shaker.
In terms of the housing gig – there’s obviously a right way and a wrong way to separate Eastman from his flat. The court simply (and quite rightly) found was that the dim-witted bureaucrats at ACT Housing with the help of puffed-up dolts at various review and appeals boards managed to stuff up the eviction. No one has said that he deserves to stay – simply that if he’s to be evicted, then it should be done properly.
Having said that, at least Eastman is not behind in his rent – how many other ACT Housing tenants can claim the same.

He’s where he needs to be, for whatever reason. If not for the ostensible one, then for literally hundreds of others.

I guess that there are still a few dim-wits about who genuinely believe that Eastman killed Winchester … that aside, it ofetn takes intelligence to make the right decision – I guess that’s why you’ve got to be damn smart to be a judge … but any twit with mush for brains can be told what to think ‘tween the pages of a tabloid.
