Unfit to plead but fit to drive?

The Canberra Times reports that a 60yo man who caused the death of a motorcylist in 2006 is unfit to plead due to alcohol-related dementia with the judge quoted as saying he would not be able to understand the nature of the charge or his rights in relation to the jury, and he would not be able to follow the trial proceedings or instruct his lawyers.

A doctor’s report says that he suffered from an amnesic syndrome as a result of frontal lobe degeneration found in alcohol-related dementia, which affected ”encoding of new information as well as retrieval of past information”

This level of impairment is pretty extreme so WTF was he doing behind the wheel of a lethal weapon? Especially given that several people I know have had their licence revoked immediately upon diagnosis of Alzheimers.

wonder how many more are out there like him? Protected by a system that will not introduce compulsory medical/competancy testing before licence renewal only because it fears the old gin swilling dodders outcry

Scooter riders don’t fill me with confidence either, judging by the way the majority ride them like the were driving a car, makes me wonder when they will put some extra effort into rider training. But then drivers aren’t much better.. start off bad and get worse?

Anyway, story at hand. The guy has been subsequently been diagnosed with the condition which is obvious from the statement “Griffith, now lives in a dementia ward of a nursing home”. While obviously his drinking caused the accident and the rider’s death and should normally have the book thrown at him, little point jailing a guy who lives in a dementia ward. I’d say that would be worse than jail, he dug his own hole and is now paying for it, pity he killed someone in the process.
