Rebecca Massey breaches bail, gets more bail, living in Ngunnawal

The Canberra Times informs us that alleged knife murderer Rebecca Massey has breached her bail by having ex-boyfriend and alleged evidence concealer Michael Marshall around to her Ngunnawal govvie. But hey, bail conditions in the ACT are really just suggestions.

It’s been nearly two years since Elizabeth Booshand was stabbed to death at Charnwood shops in 2008.

Massey’s barrister, Jack Pappas, said Marshall might in fact become more hostile if prevented from having a relationship with his client.

He told the court that there was nothing to suggest Massey had gone in search of Marshall and no hint that she had otherwise breached her bail since it was first granted. The court heard the woman applied to change her bail conditions so that she could associate with Marshall without breaking the rules governing her freedom, but that the hearing was adjourned on June 2.

Justice Refshauge noted that the woman was unlikely to face trial before 2012 and said she would be put in custody if she transgressed her bail conditions again.

And we call this a justice system?

Yes it is sad that her son witnessed it, but his mother took the knife with her, don’t tell me she didn’t intend to use the knife, she didn’t give her son or the victims daughter a second thought or anyone else for that matter, they only thing she wanted was to start a fight.
If you were there and a witness, then why was she sentenced in the first place, ok she’s appealing the sentence, so what, she may not get it, she had a jury, twelve people, they heard all the evidence.

Whatever you say about how reformed she is, the community is a better place with her behind bars.

She is a beautiful person, a loving mother and a faithful, loyal, affectionate, nurturing and dedicated partner.

If someone repeatedly threatened your life i think you just may consider carrying something to protect yourself. Being that your the perfect citizen I presume that you would abide by the law and allow yourself to be stabbed to death and not even attempt to defend yourself.NOT!!! Ms booshand had a propencity for violence and was a known heroin dealer for about twenty years.given that, I don’t blame Rebecca for carrying a knife to defend herself. I know lots of “decent people” who live “normal lives”. I have never known any of them to attend their local takeaway with a ~30cm kitchen knife “just in case”…

my mistake… ~30 kitchen knife = Pocket knife… still; most of my friends don’t carry even those around… suburbia hardly necessitates tools of that calibre…

When people go stabby, in 99% of cases my assumption is they they are either criminally dangerous and should be separated from society; are seriously mentally unwell and should be separated from society; or are badly addicted to drugs and should be separated from society.

If the courts could let us know the reason they see that this person falls in the other 1% I would be grateful.

It has been my experience that “decent people” who live “normal lives” tend not to stab or murder others. Also, you really need to learn how to write using proper punctuation. You aren’t doing much to help the Charnwood stereotype.

As for the bail issue – it’s just another reason why the “justice” system in the ACT appears to be in need of serious repair. But shhhh… let’s not type too loudly or Not/Lookout Smithers will be in here banging away about how perfect the legal system is and how it’s the media that’s always wrong. I don’t think I could handle having to see that nonsense again right now.

OK – Let’s say that Justice Refshauge’s judgement is fair and reasonable, taking into account all the circumstances.

It’s not unreasonable for an ordinary person to feel that someone who’s stabbed someone else to death should quickly be locked up, even if that’s an unreasonable expectation.

Perhaps if the judges explained to us why our expectations were unreasonable and their judgements were correct we’d have a better idea of why the two seem so far apart.

I have a suggestion, how about the accused take up residence with the judge who makes such a decsion to let her out on bail and see if he/her feels that they are living in a safe home environment with this type of person living with their family and spending quality time with their loved ones and friends! I mean after all Hannibal Lector joined his friend for lunch!

When it takes 4 years for something as serious as a murder to be resolved, I think it’s pretty fair to say the system is broken.

Guys the reason it takes soooo long to get to supreme court, is there is a back log in the court, don’t forget we have only one supreme court house here in Canberra, yes it is a joke, but not funny for the victims of crime who have to wait to get to trial.

So Bos, please lead this poor ignorant bogan toward enlightenment. If the justice system in this town is a model of efficiency; if our judges are directly descended from Solomon himself, why is it that:

-Four years can elapse between a crime and a judicial decision

-Bail conditions are flexible, the amount of flexibility to be determined by the person on bail, not the court

-The citizens of the city should not comment on any judge’s decision, as they haven’t read the ‘full argument’ from each side and have had no experience making judgments (Was there some compelling argument in this issue that wasn’t reported Bos?)

That depends on the specific details of each case.

There are sooooo many things wrong with that statement, but I will say few things:

1. Murder has no statute of limitations
2. The matter is before the court and the statute of limitations do not apply anyways

Who said that it is the Police/prosecutions fault the matter is dragging on …… it’s not all that uncommon that:

1. The defence holds up proceedings for what ever reason/s
2. Defendants sometimes don’t want speedy trials

As far as I am aware, the statute of limitations apply to summary offences, not indictable ones.

Given the recent coincidence of local crims coming to sticky ends on the road, perhaps a half arsed attempt to teach Ms Massey to ride a motorcycle prior to turning her loose could have a wondrous result for the community.

Reckon the justice system is going to stay broke, too, until Labor gets some genuine competition from other parties. Regardless of your political leanings, a monoculture is a recipe for JLKASDKLJASDJKLASDLJK. Pronounce it as you will.

What is the point of the bail system if when breached there is only more leeway given?

If this is true, then fair enough I suppose. But if he knew of the bail condition placed upon her, and knowingly breached it, isn’t there something they can charge him with? Was she home and he turned up uninvited, she asked him to leave, end of story? Or since he was there, did they have some beers and watch the footy for a few hours?

Surely the fact that Marshal may become more violent would be a reason for them both to be remanded and not left out on the community to stab people and hide evidence at will.

If I ever do anything wrong I want Jack Pappas in my corner. The man is a genius!

Why has it been two years already, and going to take another two years for it to be going to trial? Does it take four years to organise? Is the criminal court system four years behind for everybody? Glad I’m not giving evidence, I would have a fair bit of trouble remembering anything reliable after that amount of time.
