Rebecca Massey's appeal dismissed

Charnwood stabber Rebecca Massey has, according to an ABC tweet, had her appeal against her murder conviction dismissed:

In our opinion, for these reasons, his Honour did not misdirect the jury in relation to self-defence.

Having read the judgement into the murders of Bolas and Tattersall by Scott McDougall i would be flabbergasted if his appeal of self-defence against Bolas was upheld. McDougall claimed that following a heated argument with Bolas,the deceased apparently grabbed a meat cleaver threatening to use it on McDougall who after a struggle managed to take it off Bolas and then proceeded to attack Bolas inflicting horrific wounds that killed him.He then attacked Tattersall with the same sort of ferocity ending her life.

While his claim of self-defence is specifically against Bolas the autopsy revealed that both the deceased suffered similar injuries of a horrific nature and in my opinion this fact alone should negate any claim of self-defence.Given there were no witnesses to this horrific crime,clearly it would be advantageous for McDougall to paint a distorted picture of what transpired.He,in my assessment,was correctly found guilty of two counts of murder and should rot in prison.

Rebecca deserved what she got, why on earth would she have a knife on her, to stab the poor woman after goading her whist the victim was in the chicken shop. If she has mental health issues, it’s from all the drugs she has taken over the years, no one made her take the drugs, or stuck a needle in her arm, she did that herself, I saw her smash my car window, when she was a skanky drugo, all I can say is thank god she didn’t get her appeal. Sucko!

Makes me have hope that McDougall (Monster) doesn’t get his appeal accepted, I ready don’t know why they waste the courts and taxpayers money, oh yes I do, the greedy people who are their defenders in court, their just like car salesman, when their are monsters like McDougall, they rub their hands together, no doubt about his conviction, he should be locked up and the key thrown away. I often wonder if he should get the death penalty, like Chinese torture.

Massey’s chance of having her appeal upheld on the basis of self-defence was buckley’s and none.I would describe both Massey and Booshand(dec) as being farked up aggressive low life junkies who,although once friends,had a falling out(probably over heroin) and hated each so immensely that they literally wanted to kill each other.The only unfortunate scenario was that they didn’t both have flick blades.

The keyboard warrior in me wants to agree. Then reality steps in and says this logic must be flawed.
But I’m buggered if I can see what that flaw is :-\

I think the point is that mental illness is not an excuse for you to put a blade in someone. It might be a reason, but the consequences of that action should be the same for everyone.

Also, how do we differentiate between mental illness and anti-social behavior? Are they the same thing and how should society react?

Justin’s point seems to be that we all (including the mentally ill) suffer stress and hardship and manage it without assaulting other people. Or killing them.

As someone else said, we don’t know this woman’s mental health status. She might have problems or she might just be a toxic human being that’s best locked away from the rest of us. In any event, we’re all a little safer with her off the streets.

The point is

Mental illness should not be used as an excuse to break the law.

Mental illness does not mean you can go around doing whatever you want to whoever you want.

Where does it even say any Massey has any mental illness? They are all scum that deserve to be locked up and ridiculed by everyone else as the human trash they are.

Do you think this Rebecca person goes around stabbing any stranger in the street?
Don’t you think she might have problems, but which she was able to keep away from the public so that she wasn’t a nuisance to the general public?
Don’t you think emotions were running high and that things may not have happened if only?

Having said that, the fact remains that she has committed a crime, and she will do the time.

But I do not believe she is a general menace to society. She has problems, which needs help.
What she doesn’t need is for us to air our opinion without understanding 15 years of her relationship with the victim.

If you want my opinion on real murderers, I’d be very interested in the case where Liang Zhao was killed while walking home on Northbourne. I’m more than happy to cry for capital punishment based on the outcome of the court case for this.

The Judgement makes for very depressing reading indeed. I now have images of unkempt, angry bogans yelling and chasing each other over chicken take-away. The sad state of our community.
