Migrants could be appointed to permanent ACT public service positions under proposed law change

Migrants to Australia could soon look to Canberra’s public service for permanent positions under proposed amendments to employment laws.

Chief Minister Andrew Barr presented the Public Sector Management Amendment Bill 2024 to amend the 1994 legislation which helps govern the public sector and service.

Currently the Territory’s law only allows Australian citizens or permanent residents to be appointed to ongoing positions in the public service.

“To ensure Canberrans receive vital public services, some areas of the service have historically engaged foreign visa holders … on temporary employment contracts,” Mr Barr explained.

He said recent changes to the Commonwealth’s Fair Work Act 2009 would limit the ACT’s ability to continue this practice and so the Territory’s legislation needed to change to ensure the ACT – as an employer – was still compliant with federal law.

The Fair Work Act 2009 changes prevent an employer from engaging a person on certain fixed-term employment contracts that exceed two years, and from renewing existing contracts where the consecutive periods of employment either exceed two years or would amount to two consecutive renewals.

Mr Barr said his bill would remove the requirement that a person had to be an Australian citizen or a permanent resident to be appointed to office.

“This will allow migrants who hold a legal right to work in Australia to seek appointment to an ACT public service position for as long as they hold that legal right to work in Australia,” he said.

“This [will] ensure we have the workers to deliver the all-important services that our community needs.”

The bill will be debated during a Legislative Assembly sitting week.

What’s the point in giving permanent employment to someone on 6-month or 12-month visa? You fill positions with temporary visa holders and if their PR visa application is unsuccessful, you’re back to square one. ACT Government is always the first to implement sloppy policies. In NSW, you have to be a PR to get a permanent position.

This is mostly a measure to streamline existing processes, allowing workers on temporary visas (often already on the path to PR/citizenship) to be offered ongoing contracts instead of a series of temporary contracts. I don’t see it changing the composition of the ACTPS too much.

It’s obvious that governments, state and federal are trying to destabilize our country. The divide and insecurity we have at every level should concern us all. The moral fibre of our society has been smashed over the last few years by the referendum,law changes, immigration, protests, cashless etc.
All these things a government could stop..but they aren’t because they are behind the unrest.

Either stop smoking whatever you are smoking, or take up smoking. Whatever option applies.

How does this destabilise anything? They are already working in the ACTPS on temporary contracts, some for many years until they become Australian citizens and can become permanent under current rules.

And do tell how does cash create the ‘moral fibre of our society’?

The ACT needs less Public Servants and more tradies

At a time when citizens are concerned about the cost of living crisis… yes let’s add another area of concern to the mantle with greater foreign interference?

Open the flood gates and let all unvetted migrants take our jobs and infiltrate our country from within… let’s start with ACT Government first?

I’m more concerned that citizens and permanent residents are not getting permanent ongoing employment in the ACTPS currently. There is still too much outsourcing scams (e.g. ‘cleaning and IT) and insecure work in the ACTPS. The fed FWA changes are aimed ongoing employment for Australian citizens and permanent residents. The fact that its being used as an excuse to promote the interests of foreign workers while there are actual local that could do the work is perplexing.

If the ACTPS paid decent wages for IT jobs, they wouldn’t need to outsource.

I only wish ….. What is decent for some is way over the top for others.
ACT Government has a starting salary of $76,000 for graduates.

This is one of the highest salary packages for graduates in the in the public sector in Australia.

Graduates will get to a salary of around 82,000+ by the time they complete the graduate program.
