A roofer used a knife to stab at a man and brandished the weapon in such a way that other people inside the home decided to flee – including one woman who jumped out a window.
It was not the first time Brett Thomas McIntosh appeared before the courts. He had already been sentenced over an assault in July 2019 in which he dragged a man from a car before he and his co-accused punched and kicked their victim in the face, breaking his jaw.
The 30-year-old has now been returned to jail over the knife incident.
Police were called to a home in the south Canberra suburb of Conder at about 1 am on 23 December 2021 following reports of people arguing, court documents say.
They saw McIntosh, who was holding a large kitchen knife, arguing with a man standing on the opposite side of a closed fly screen door.
McIntosh shoved the knife through the fly screen twice towards the man’s chest and face.
Police told him to drop the knife and arrested him shortly afterwards.
On Thursday (17 March), Magistrate Glenn Theakston told the ACT Magistrates Court that after the intoxicated McIntosh began brandishing the knife, people left the home as best they could, including one woman who went through a window.
He described it as a “very serious example of this type of offence”.
McIntosh’s lawyer, Taden Kelliher, said his client had pro-social aspects and was highly skilled in the roofing trade.
He pleaded guilty to a charge of possessing an offensive weapon with intent and was sentenced to two months’ jail, which will end in May 2022.
While McIntosh spent several months behind bars over the 2019 attack, for which he pleaded guilty to causing grievous bodily harm and assault, he was allowed to leave jail in August 2020 on a two-year good behaviour order after being handed a suspended sentence.
As he was convicted for the knife incident, Magistrate Theakston also committed him to the Supreme Court to be dealt with over a breach of this earlier sentence.
