Javarne Saipani, the next recidivist offender?

Our favourite sentencing judge, Justice John Nield, has sentenced another violent young man according to the Canberra Times, this one to weekend prison for 7 months. This charming piece of humanity already has 12 offences, but his first as an adult.

No doubt in my opinion Javarne Saipani will feature heavily in future court reports, based on the fact that he was already on a good behaviour bond at the time of this latest assault.

The quote he posted is indicative of the type of boy one wouldn’t want one’s daughters associating with methinks..

I love seeing that plea-bargaining is becoming entrenched in our criminal justice system.

If one reads the judgement one can understand why Nield’s hands were tied to an extent for there was more than one attacker and apparently the other attacker inflicted more serious harm to the victim and was subsequently sentenced to imprisonment for nine months, with five months to be served by periodic detention and four months suspended upon entering into an undertaking to be of good behaviour for two years.

Given those circumstances Nield had little option but to impose a similar sentence.Saipani’s sentence is marginally more severe than his accomplice but I would agree that he deserved more jail time.

The other totally unsatisfactory aspect is that the offence occurred in September 2011 and it has taken almost two years for Saipani to receive his punishment.We can largely thank our esteemed AG Corbell for the pathetic delay.
