The lawyer you need may depend on the nature of the crime of which the person involved is accused. Not knowing the detail of the crime alleged, I would recommend Karen Fogarty from Colquhoun Murphy. She has a science degree (math) and is quite computer literate.

xceL – I am not sure what you mean by the Defendant having to pay Court fees? I was referring to what your defence team might charge you. If you are found not guilty you can apply for costs from the prosecution, but even if costs are granted it won’t be for the full amount.

kos – You don’t need to get an “evidence warrant”, if proceedings have been commenced you can simply get a subpoena issued for that information. Quite a simple matter.

A lawyer who knows what they are doing and a case will cost upwards of 10k, you’ll need to decide not only if its worth it, but if you have sufficient evidence. As computer intrusion is actually a crime, you should be able to enlist the assitance of the police, in our case the AFP. Call Ph:(02) 6223 3216 to get them directly or log a normal case on 131444. For other help;

CERT AU may provide some assistance for free, I have had them contact me in regards to personal data on the internet etc.

If the evidence isn’t handled correctly from day dot (copy taken, time drift noted and sighted, chain of evidence etc) then your case will be fairly useless. In order to get any additional information from 3rd parties such as telecommunications carriers you will need not only a case logged with the police but an evidence warrant, and you’ll need this in order to prove that something happened on the malicious attackers end as well as your end (eg it wasnt spoofed).

It won’t take long to rack up $10,000 in legal fees. I have seen some defended matters that have dragged on and racked up many times that amount in legal fees.

Most lawyers will generally give you the first consultation free, but don’t expect much from it, it will probably only last 15 minutes. They will usually tell you that they need more information and details from you and you will require further appointments for which you will be billed.

If you do engage a solicitor they will give you a cost agreement to sign which should details their costs and their estimate of what the case should cost you.

I’m only after an initial consultation so I feel it would be handy to speak to a solicitor who has some experience or knowledge of computers or cases to get the right advice.

You could try Jason Parkinson at Porters Lawyers, I know that he has experience in that area. Jason is also a former policeman so he is familiar with police procedures.

Most decent lawyers, even if they are computer savvy, will still call in a recognised IT expert to consult with and to provide expert evidence in Court.
